Welcome to Tangerine Poetry website terms and conditions of use.

These terms and conditions apply to the use of this website, and by accessing this website and/or placing an order you agree to be bound by these terms and conditions as set out below. If you do not agree to be bound by these terms and conditions you may not use or access this website.
Before you place an order, if you have any questions relating to these terms and conditions please contact us using the contact information provided.​

Description of Services & Definitions.

Tangerine Poetry (or “we”) provides paperback books, audio files and audio cd’s, to our Customers, either directly or via our website, all of which constitute our core business or service (our “service). “Conditions” means these terms and conditions, “product” means a product displayed for sale on the website, “we, “us”, “our” means Tangerine Poetry, “you”, “your” means the user of this website, “working days” means all days other than Saturdays, Sundays, and public holidays.


Use of Tangerine Poetry website

You are provided with access to this website in accordance with these Terms & Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.


Restrictions
In placing an order you confirm that you are aged 18 or over.
All orders are made subject to these terms and conditions.

The contract between us
When placing an order, you agree that any, and all information given is accurate and complete. All orders are subject to acceptance and product availability.
We aim to stock all products listed on our website. However, circumstances may arise which could result in one or more products being out of stock. If this should affect your order we will email you with availability information so that you may decide to cancel if you no longer wish to proceed.
No contract for the sale of any product will exist between you and us until payment of the whole of the price for the goods ordered has been received. Payment is taken at point of order, regardless of whether the item/s ordered are available for immediate despatch.
Once payment has been sent you will receive an email which will confirm the amount and details of the order.
This confirmation email will be sent to the email address given in your order form and will detail products ordered, order number and the total price (including p&p, otherwise known as shipping).
Our acceptance of your order brings into existence a legally binding contract between us on these terms.
Any term sought to be imposed by you in your order will not form part of the contract.
You must check all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect.
If your order has not been accepted, you will receive an email from us telling you the reasons why.
We are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website.
If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether. If we are unable to contact you or we receive no reply from you, we will cancel your order.
We reserve the right to change prices listed without notice.
We reserves the right to refuse to supply to any individual or company.

Withdrawal by you from the contract
If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract and these are set out here. This right to withdraw does not apply to business buyers.
• You may withdraw your order for goods at any time up to the end of the fourteenth working day after you have received the goods.


There are two circumstances in which you cannot withdraw your order, as follows;

 a) where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered

b) the product is personalised to your requirement.

• To withdraw your order you must notify us in writing at the address set out in the Returns section of this website
• If you have received the goods before you withdraw your order, then you must send them back to our return address at your own cost and risk, unless the goods were supplied faulty or damaged. If you withdraw your order but we have already processed the goods for despatch and you have yet to receive them, you must not unpack the goods when they are received by you and you must send the goods back to our return address at your own cost and risk as soon as possible.
• Once you have notified us that you are withdrawing your order, any sum debited to us from your credit/debit card or PayPal account will be re-credited to you within fourteen days of receiving returned or unwanted items.

Deliveries

Items that are in stock will be with you within 2-3 working days (7+ working days overseas), with the exception of bank holidays.  All items are delivered by UK Royal Mail.  Goods will be sent to the person and the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock. You will become the owner of the goods you have ordered when the goods are received by you.

The prices payable for goods are as set out in the website, inclusive of VAT where applicable (books are currently zero rated). Customers ordering for delivery outside of the UK will be responsible for payment of any local taxes payable including VAT, and will be required to pay extra for delivery and clearance where necessary.

We are happy to accept bulks orders however this may affect delivery times. Please contact us at admin@tangerinepoetry.com prior to placing an order of more than 5 items, to check that sufficient stock is available and delivery arrangements are suitable.

Availability of goods you order
If we have insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible by email at the address given by you in your order form.  We will not be obliged to offer any compensation for disappointment suffered. We will take all reasonable care to ensure that all details and availabilities of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up-to-date as possible, the information including product descriptions, prices and availability at a particular time may not reflect the position exactly at the moment you place an order. Please note that the price the goods are offered for tender are as displayed in the shopping basket

Returns & Replacements

In the unlikely event that your order arrived damaged, please accept our apology. In order to process any claim or exchange quickly, please send us images of the item/damage, the packaging, delivery note/receipt to the following e:mail:-

You can return products to the following address provided, under the following conditions:
• The item must be returned within 14 days of receipt
• Books must be in unused (re-saleable) condition

• Audio CD’s must be returned in new condition with its original casing and inserts

Please repackage the products carefully and securely and send them by post, to the address provided, together with the reason for return, a copy of the invoice/delivery note, your email address, order number and instructions whether you would like a refund or replacement.


Returns by post are made at your risk and cost. We recommend that you use an insured registered mail service as returns not received by us cannot be credited to you or replaced.

Refunds will be credited to the same card or Paypal account used for the order. We cannot refund products which have been personalised to your requirement. We will refund the cost of return postage for any error on our part.

Where refunds are requested, we will make the refund to the card that was used to pay for the original order. We are not able to make cash refunds.  We will issue the refund within 14 days of the return being received, though it can take up to 30 days to appear on your credit card statement. 


Online Transactions

Online transactions including credit/debit card transactions on www.tangerinepoetry.co.uk are secured using the SSL encryption method and hosted with Wix. This is to provide immense security and protection to our customers. We also accept payments via Stripe and Paypal, a credit card processing service people all around the world know and trust. Paypal and Stripe will charge you for your order irrespective of whether all items are in stock. If any item cannot be supplied or you change your mind, your debit/credit card or PayPal account will be credited with the appropriate amount.
All product prices and delivery charges are shown in UK pounds sterling. We do not store or hold client credit/debit card information. Tangerine Poetry does not store any credit/debit card details on or offline. 

Protecting Your Privacy

Your privacy is of paramount importance to us and something we take very seriously. We are subject to the General Data Protection Regulation and will never disclose your information to anyone and will alert you to any requests we might receive.


Our primary goal in collecting personal information from you is to:

  • verify your identity;

  • help us improve our products and events and develop and market new products and events;

  • carry out requests made by you;

  • investigate or settle inquiries or disputes; and

  • use as otherwise required or permitted by law.

 In particular, we use your personal information for the following purposes:

Fulfilment of Products and Events

We collect and maintain personal information that you voluntarily submit to us during your use of our website or whilst at an event.

We use the contact and payment details you have provided to us so that we can fulfil the supply of products and services you have ordered from our website. This includes your purchase of products, your attendance at events hosted by us and the processing of returns and refunds.

Who do we share your personal information with for this purpose?

We will share your personal information internally with our staff, and with the following categories of third parties:

  • To verify card payments and process refunds - credit card companies and other payment providers;

  • To deliver products and process returns – delivery and courier companies;

  • To organise events – any applicable third party hosting the event and third-party ticketing companies.


What is our Legal Basis?

It is necessary for us to use your personal information to perform our obligations in accordance with any contract that we may have with you for the supply of goods and services.


Marketing Communications

We carry out email marketing using your personal information.

We send you marketing communications by email to inform you about upcoming events and promotions. We will only send you marketing communications via email where you have consented to receive such marketing communications. We obtain your consent either via our website, a specific request that you have made via email or via a form that you fill out at one of our events.


How do we protect your data?

We take the security of your data seriously. We have internal policies and controls in place to try to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the performance of their duties.

Where we engage third parties to process personal data on our behalf, they do so on the basis of clear instructions, are under a duty of confidentiality and are obliged to implement appropriate technical and organisational measures to ensure the security of data.

How long do we keep your data?

Where we are holding your data for the fulfilment of products and events, we will hold your personal data for a period of 5 years, following your purchase or attendance at an event, after which it will be deleted.

Where we are holding your data for customer support purposes, we will hold your personal data for a period of 5 years following your purchase or the resolution of your inquiry / complaint, after which it will be deleted.

Where we are holding your data for email marketing communications and promotions, we will hold your personal data permanently unless you unsubscribe from our communications. In which case we will delete your details.

Your Rights

As a data subject, you have a number of rights. You can:

  • access and obtain a copy of your data on request;

  • require us to change incorrect or incomplete data;

  • require us to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing;

  • object to the processing of your data where we are relying on our legitimate interests as the legal ground for processing; and

  • ask us to stop processing data for a period if data is inaccurate or there is a dispute about whether or not your interests override our legitimate grounds for processing data.
